Man Arrested For Driving A Wheelchair While Drunk

A man has been imprisoned for drink driving after he was found over the limit while driving a motorised wheelchair.Ronny Scott Hicks was caught by cops after motorists had made complaints of a man on a mobility vehicle blocking traffic in Palm Bay Florida.

The 54-year-old ma was said to have been slurring his words when police arrived & they also smelt alcohol on him. Officers took Hicks into police custody after her refused to take the breathalyser test.
He refused treatment for a wound on his body and was placed in cells at Brevard County Jail.
Hicks has two previous drink driving convictions - although non of them involved a  wheelchair, His bail has been set $5,000 (£3,227).
This isn’t the first unusual drink driving incident - last month a cowboy in Louisiana managed to avoid charges after he was discovered drunk on his horse.
He said that it was “safer” to let the animal take him home after having a little too much to drink.

Last year in Marondera police beat up two-year-old child and her father who were shopping. They were beaten with baton sticks and had to be taken to hospital for treatment. That incident happened after a Kombi Driver was killed over a bribe.

The collection of spot fines from motorists by the police and the impounding of their vehicles if they fail to pay up is illegal and must be stopped forthwith, a High Court Judge has said.

Officially opening the 2015 Masvingo High Court Legal Year yesterday, Justice Francis Bere said there was neither a legal framework nor any law which either compelled a motorist to pay a spot fine or which empowered police to impound someone’s vehicle.

He said Section 356 of the Criminal Procedure and Evidence Act (Chapter 9:07), which is often cited on the matter, did not give police officers powers to force a motorist to pay a spot fine.

Justice Bere said spot fines and their retention by the police needed to be clarified as the matter has caused a lot of debate.

“It has been reported extensively in the media that these collections by the police are meant to meet the force’s pressing operational needs,’’ he said.

“I fully understand the predicament the Home Affairs Ministry finds itself in, but it occurs to me that currently there is no legal framework justifying the manner in which these collections are being done.

“There is no law which compels a motorist to deposit a fine with the police if he desires to challenge the alleged offence, but it looks like the motorists are being forced to pay these fines on our public roads irrespective of their attitude to the charges.

“Any attempt to refuse to pay is met by threats to have the vehicle impounded by the police.’’

Justice Bere decried the continuous flouting of legislation that governs the collection and retention of spot fines, a development he said was affecting the force’s ability to fully execute its core business.
“The Section (356 of the Criminal Procedure and Evidence Act, Chapter 9:07) compels the police to forthwith transmit all the documentation to do with the payment of spot fines to the court for confirmation by a magistrate,” he said.

“All these provisions of the law are being flouted, with everyone watching helplessly whilst this illegality continues. There may be no problems with the police operating as an extension of Treasury, but if that is what is desired, then the legal framework must be put in place to support such kind of a development.’’

Justice Bere said the police were “cursed” if it was true that the force was superintending co-ordinate collection of “security fees” to give commuter omnibus drivers free passage at roadblocks.

“Quite often, one hears of more illegal collections which are being made by the police,” he said.

“There is talk of well co-ordinated collections of security fees on our public roads, particularly from commuter omnibuses, which fees are meant to give commuters free and unhindered passage at police roadblocks.

“If this is true, then the department (police) is surely cursed. How can a nation continue to condone such malpractices which create a breeding ground for corrupt tendencies?

“We talk of determination for the need to rid this country of corruption. How can we achieve this when we allow our police officers to conduct themselves in such a corrupt manner? My view is that all these issues must be seriously looked at and corrective action be taken without further delays.”

Justice Bere said it was crucial for the police to jealously guard its repution as an international brand by fully and fairly playing its role in the justice delivery system.

Turning to the contentious issue of the death penalty, Justice Bere said there was urgent need to align certain laws with the provisions of the new Constitution to avoid confusion.

He said some High Court judges strongly believed that there should be no imposition of the death penalty at the moment until a new law that defines aggravating circumstances was created.

MUTARE – There was drama in Mutare’s Hospital Hill low-density suburb on Monday morning when a highway traffic police patrol Mercedes Benz caught fire during a high speed chase with a commuter omnibus that had flouted road rules.Drama as police Mercedes catches fire during kombi chase

Residents from the relatively quiet hilly suburb said they heard tyres screeching as the police vehicle followed up the Toyota Hiace, which had diverted from the main tarred road near Mutare Provincial Hospital and drove into the badly damaged dirty roads in the suburb.

In no time, they saw smoke gusting from a distance and subsequently heard loud cries as the police officers screamed for help from members of the public to put out the fire on their service vehicle.

When Weekender visited the scene, a fire tender from the Mutare City Council had quickly responded to the emergency call and managed to douse the flames with water.

Another highway patrol vehicle also rushed to the scene to assist their colleagues, who apparently were left awestruck by the foiled kombi chase.

The Mercedes Benz C class vehicle, which is valued at more than US$30 000, had its wiring system badly damaged by the fire, which started from the engine area.


“The car hit a pothole and caught fire,” said one of the police officers who did not identify himself.

Although the police officer downplayed the high speed chase incident saying they were just patrolling the pot-hole riddled suburb with little traffic activity, residents and vendors who sale wares in the area said they witnessed the typical “Fast and Furious” movie incident.

“We first saw the kombi speeding down the damaged steep slopes and moments later the Mercedes Benz came roaring.

“These guys were determined to catch up with the kombi. Some metres into the suburb the vehicle caught fire and we rushed to help,” said a vendor.

Kombi drivers and pirate taxi operators appear to have devised ways of outwitting chasing traffic cops. One such trick is to divert from the highways into dirty roads where cops behind the wheels of state-of-the-art traffic patrol vehicles and motorbikes find it hard to manoeuvre the bad roads.

AGAIN, Lightning kills Bulawayo schoolgirl

BULAWAYO – A grade 6 pupil died yesterday after being struck by lightning while walking to a dustbin within the school grounds.

Tragic Sandra Netsanza, 11, who had just helped clean up a classroom at Gampu Primary School in Bulawayo’s Mpopoma suburb, was carrying a dust pan heading to a waste bin with classmates when lightning struck at around 1PM, witnesses said.A teacher, who was among the first people to find young Sandra’s body, told The Chronicle: “It was around 1PM after the lunch bell had rung. Sandra and her classmates had been sweeping their class and they were going to dispose of the rubbish.
“It was drizzling at the time after heavy rains earlier. Suddenly, we were jolted by screams and we rushed to find Sandra already dead, apparently struck by lightning. Her mates that she was walking with were spared though.“It was slightly strange really, because there is a tall tree just metres from where she fell. Were we not taught that lightning strikes the tallest object? It’s sad really, many thought it was African science (witchcraft).”


When our news crew arrived at the school shortly after 4PM, Sandra’s distraught schoolmates were struggling to comprehend what had just happened, dozens of parents rushed to the school to pick up their children.Her relatives, who are members of a church sect known as Vapostori, had also arrived. Emotions ran high as they manhandled a news crew from another newspaper and threatened our photographer. Dressed in their white gowns, they also threatened witnesses from talking to journalists.Police took more than three hours to arrive at the school, finally removing Sandra’s body from the scene after 5PM. By then, a large crowd had gathered.
Her body was placed in a silver metallic coffin which was loaded onto the back of an open-top police truck.


On Monday, six children and an adult were killed when lightning struck two huts in Mugwinyi Village in Bikita.The dead have been identified as Marian Nebvuma, 32, Fadzai Chenjerai, 11, Gloria Chenjerai, 5, Odrey Masunda, 4, Esther Muchakagara, 5, Claudia Mugwinyi, 4 and Crywind Mugwinyi, 6.Meanwhile, a Grade 6 pupil at Marvel Primary School pupil in Filabusi collapsed during an athletics practise session and later died after efforts to revive her failed.The 12-year-old girl, identified as Mercy Chizema, collapsed in the school’s sports field on Monday at around 2.30PM.


A teacher said: “After running for a distance of about 400m, she fell to the ground. The training teacher attended to her and later called other teachers to the scene.“Everyone thought she had fainted. Efforts were made to resuscitate her but to no avail. She was quickly rushed to Filabusi District Hospital where she was pronounced dead on arrival,” said the source.Matabeleland South provincial police spokesperson Inspector Philisani Ndebele said: “We received a report of a female juvenile who collapsed at the school grounds and was certified dead upon arrival at the hospital. Police are keen to question Spirit Embassy Ministries founder Prophet Uebert Angel Mudzanire on allegations that he defrauded a Harare man of his vehicle, a Bentley worth $300 000.

Angel is said to have connived with his brother Benjamin and Anderson Tagara to allegedly defraud Mr Ndabazinengi Shava, the director of Faith Age Holdings Zimbabwe.

This was revealed following the arrest of Tagara (35) who appeared in court yesterday before Mr Milton Serima charged with two counts of fraud.

According to the State, Angel who is still at large, is the main perpetrator of the case.

Benjamin, who is said to be Angel’s accomplice, is also still at large.

Tagara was remanded to February 17 for trial on $200 bail.

Law officer Mr Editor Mavuto from the Prosecutor-General’s office appeared for the State, while Mr Tapiwa Makanza of Nyamayaro Makanza and Bakasa legal practice, acted on behalf of Tagara.

It is the State’s case that sometime in February 2012, Shava intended to import a motor vehicle, a Bentley from the United Kingdom.

Shava, the court heard, contracted his long time friend Tagara to buy the vehicle on his behalf and the two entered into a verbal agreement.
During the same year in March, the State alleged that Shava gave Tagara $240 000.

Tagara advised Shava to send the money through Centrust Pvt Ltd, a company run by Willard Kafalimani.

Tagara, it is alleged, collected the money from Kafalimani and imported the said vehicle which he registered in his name.
He later handed over the vehicle and the registration documents to Shava, the court heard.
Sometime in 2013, Shava, the State further alleged, lost his vehicle to Prophet Uebert Angel through fraudulent means.
Between May and October 2013, Tagara acting in common purpose with the man of cloth signed a fake agreement of sale to the effect that Benjamin had bought the said vehicle from Tagara for $76 000.

Benjamin is said to have taken the fake documents to the Zimbabwe Revenue Authority, the police and the Central Vehicle Registry and acting on the misrepresentation, the Central Vehicle Registry registered the motor vehicle in Eubert Angel’s name.

Shava discovered the offence and filed a report to the police against the trio.

Police detectives started conducting investigations and on December 16 last year, they recovered the fake agreement of sale.

As a result, Shava suffered a total prejudice of $300 000.

What started as a normal day for a Harare woman who works in Msasa turned into a nightmare after she was dragged from behind by a robber while on her way to work and force-marched to a nearby maize field where she was held hostage in the nude.

The 28-year-old woman was forced to undress and her clothes were used to tie her hands and legs and to gag her.

The Harare Magistrates’ Court heard yesterday that the woman was only released at around 4pm after surrendering her mobile phone and laptop. She had been detained from 7am.

She was assaulted all over the body by the assailant who threatened to rape her if she did not yield to his demands.

Joel Magombedze (39) pleaded guilty to kidnapping the woman and robbing her and will be sentenced today.

During the nine-hour ordeal, the court heard that Magombedze moved the woman from one maize field to the other while she was in the nude.

After pleading guilty to the charges, magistrate Mr Milton Serima asked Magombedze why he committed the offence.

He pleaded for the court’s leniency, saying he had a lot on his mind as he had problems at home.

“Handidi kutambisa nguva yedare mhosva handirambe ndakaipara (I do not want to waste the court’s time. I am pleading guilty),” he said.

“I do not know what came over me. I was under a lot of pressure when I committed this offence.”

On January 29, the victim, who works in Msasa was walking along Mutare Road heading towards her workplace around 7am when Magombedze suddenly grabbed her from behind.

He ordered her to surrender her mobile phone after he had forced her to remove the security code.

Magombedze dragged her into a nearby maize field where he ordered her to remove her clothes before tying her using the clothes.

Magombedze later untied her legs and force-marched her to another maize field where he forced her to do press-ups while he was spanking her on the back.

Magombedze then ordered the woman to surrender her laptop or risk being raped.

According to the State papers, Magombedze made the woman play music on her laptop saying that he wanted entertainment.

Magombedze was arrested on Saturday after detectives from CID Homicide received information that he was in Epworth.

THERE was drama at a police roadblock near Murahwa Green Market in Mutare on Sunday morning after a motorist who had produced a fake driver’s licence went on to swallow the document after cops queried its genuineness.
Charles Nyahoda (26) of House Number 303, Area 13, Dangamvura is lucky to be alive after he ingested the A5 size laminated document in a bid to avoid being arrested.
He was choked as he swallowed the “Certificate of Competency” and had to be rushed to Mutare Provincial Hospital for treatment.
Manicaland provincial police spokesman, Inspector Enock Chishiri, said Nyahoda experienced breathing difficulties after swallowing the document.

“The motorist was stopped at a roadblock by traffic police officers. He was requested to produce a driver’s licence, but he produced a certificate of competency. However, one of the officers at the block doubted the authenticity of the certificate as it looked forged. At this point, the motorist who was standing nearby grabbed the document from the police officer and ran away.
“The officers gave chase and caught up with him. During his foiled escape he chewed and swallowed the document and upon his capture he was having breathing problems. They took him to the hospital where he was treated and discharged,” he said.

Cde Temba Mliswa has been arrested for illegally possessing seven AK47 assault rifles, with the police still to establish the intention for which he held the guns. Cde Mliswa was picked up by detectives from the CID Law and Order Section at his Spring Farm in Karoi where the guns were discovered. He is being held at the Chinhoyi Law and Order Section and is expected to appear in court today charged with unlawful possession of firearms. National police spokesperson Senior Assistant Commissioner Charity Charamba yesterday confirmed Mliswa’s arrest which happened on Saturday. “He was arrested on Saturday for unlawful possession of firearms and is likely to appear in court tomorrow (today),” she said. “Details will be furnished as and when they become available.” According to sources, Cde Mliswa was allegedly found in possession of the seven unlicensed AK47 rifles which were stashed at his farm. When The Herald visited Chinhoyi Police Station yesterday, his relatives were seen milling around the place. One of the relatives said they were not aware of the charge Cde Mliswa was facing. “We are here to find out what has happened to him,” said one of the relatives who preferred anonymity. “We just heard that he was picked up by the police, but details of why he has been arrested are still sketchy.” This is not the first time that Cde Mliswa has had a brush with the law, although he was acquitted on several occasions. In 2010, his lawyers sensationally revealed that he was facing up to 78 charges in Zimbabwe’s court system
This was after he was arrested in the same year on allegations of extorting $1 600 from relatives of his two employees and the theft of 56 cattle in Karoi. “He extorted the money from a white couple he had employed at his farm in Karoi,” said the then chief police spokesperson Senior Assistant Commissioner Wayne Bvudzijena. In the same year 2010, Mliswa along with Martin Mutasa and George Marere spent weeks in prison after being arrested on charges of fraud involving $1,05 million. The three were alleged to have defrauded a Harare man, Paul Westwood of his 50 percent shares in Noshio Motors, a registered car dealer company jointly owned by Westwood and Hammarskjöld Banda and his wife Brendaly. Mliswa was detained at Matapi police station in Mbare. After release on bail, Mliswa was re-arrested and charged for crimes dating back to 2002, which included cases of assault and common assault, theft, public violence, contempt of court, extortion, malicious damage to property, Shop Licences Act violation, Firearms Act violation and housebreaking. Mliswa and his co-accused were acquitted of the Noshio case in June 2011. Some of the other cases were also dropped in various other circumstances including state witnesses denying ever reporting Mliswa to the police. In 2013, Cde Mliswa was arrested following skirmishes where Hurungwe East legislator Cde Sarah Mahoka was injured in an attack by youths while trying to address a meeting at Zimonja Business Centre in Zvipani. Mliswa was ousted as the Zanu-PF provincial chairperson for Mashonaland West after it became clear that he supported ousted Vice President Joice Mujuru’s bid to illegally oust President Mugabe Revelations towards the 6th Zanu-PF National People’s Congress in December last year indicated that the Mujuru cabal was planning to assassinate President Mugabe if their bid to install her as the new president of both the party and the country failed with some members of the putschist cabal saying President Mugabe would be shot.

Former Zanu PF Mashonaland West provincial chairman and Hurungwe West legislator, Cde Themba Mliswa has been arrested for illegal possession of fire arms.


Cde Mliswa was picked up by police at his Karoi farm homestead and is said to have been arrested for possessing six unregistered fire arms.

Police spokesperson, Senior Assistant Commissioner Charity Charamba confirmed the arrest.

Cde Mliswa is currently detained at the Chinhoyi Central Police Station.


Police grilled after suspect found dead

SHURUGWI – Police officers based at the Shurugwi station have been grilled in an inquest after a suspect was found dead in a pool of blood with a gun-wound inside the camp’s toilet last year.
Suspicion is high that the late suspect, Simbarashe Muchengeti, whom police claim committed suicide at their camp in March last year after having been invited for questioning on armed robbery charges, could have been murdered.
According to police’s argument, the deceased smuggled a gun into the police station which he then used to take his own life after asking to use a toilet.

However, during an inquest held at the local court, magistrate Tendai Madanhire grilled Shurugwi police station officer in charge, Inspector Regiment Ndlovu, on why a proper search was not conducted on the deceased when he was arrested in connection with a crime that involved use of a firearm. “It is clear that if the police’s argument of suicide is to be believed, then there was a serious aspect of negligence because every suspect should be thoroughly searched upon arrest especially if it is in connection with an armed robbery case,” said the magistrate.
In response, Ndlovu who has served the force for 22 years, concurred but insisted the deceased took his own life.
His subordinate, detective Shepherd Mazhindu, dodged giving direct answers when asked by prosecutor Andrew Marimo if he thought it was possible that a person handcuffed could take a hidden gun from his body, shoot himself in the mouth but die while still holding it.
“I put it to you that if a person shoots themselves, there should be some action which makes the gun to fall away. How is it that the deceased died while still holding it?” the prosecutor asked.
Madanhire blasted the cops saying a police station ought to be a place known for its safety. “Don’t fear anyone. You should emulate me because I only fear God, not a mortal,” said the magistrate.
The inquest was postponed to 11 February when the state will invite a ballistics expert to give evidence. Last year the deceased’s family demanded answers about the death of their son, ruling out the possibility he committed suicide. The Zimbabwean

Cases of child maintenance after marriage mates separate are some of the most frequent issues at the civil and magistrates courts nationwide. What is worrying is the fact that most men are constantly offering peanuts to children that they fathered. That is really unfortunate because these men are accepting the fact that they are the fathers of these children yet they refuse to take care of them because they are no longer hi good books with their mother. Whilst it is understandable that someone can have irreparable differences with their wife or lover, there can never be a good reason for anyone to neglect their children because of those differences. Your children are your responsibility as a man no matter how much they disgust you or how much you hate their mother. It is advisable to continue loving your children and do your best to nurture them into responsible adults that will not separate from their mates and make their children live under a single parent. It is wise for a man to not even wait to be dragged to court over maintenance of his own children because the parental love in him should push him to naturally provide for them. That there is the potential for the children's mother to also benefit from the money or even abuse it as the guardian in charge is a fad that men can do very little about. However, women must not take advantage of the privileges that come with being the guardians in charge. They must prove to be loving parents just the same way men would have proved to be responsible by paying maintenance. They must not only ensure that maintenance money is used for their children's benefit but also play a role to provide for those chit-then in whatever way they can. The worst mother is one that sits on her laurels and wait for her ex to pay maintenance for the children, taking the money as a salary or pension of some sort. Most children lose respect for such mothers and they encourage other women to separate from their husbands so they can earn that shameful salary. There is a good number of former marriage mates that separated but parents play their roles as responsible parents with mutual respect for each other. They fought and separated but fighting ended there. Now they meet like friends knowing they need to be civil for the sake of their kids. They accept that the children conned them for life and give each other access to the children whilst the mother uses maintenance money responsibly. Such people should be emulated.

FORMER Zanu-PF secretary for Administration Cde Didymus Mutasa reportedly stole all party documents and files from the office he was using, which his lawyers used to prepare an application expected to be filed at the High Court in Harare today.

The discovery of the theft of the documents comes at a time when mystery abounds over the whereabouts of the letter Cde Mutasa purportedly wrote to Sadc as both the Ministry of Foreign Affairs in Harare, and the Sadc secretariat in Gaborone, Botswana, do not have a record of the letter.

Except for reports that the letter was lodged with the South African Embassy in London, its whereabouts remains a mystery whose authorship deepens in light of the fact that South Africa has an embassy in New Delhi, India, where Cde Mutasa claimed to be when he claimed to have written the letter.

Cde Mutasa, who was fired as Presidential Affairs Minister for working with former Vice President Dr Joice Mujuru’s putschist cabal that sought to depose President Mugabe, has been threatening to challenge Zanu-PF constitutional amendments and the outcome of the watershed 6th National People’s Congress in court, claiming it was a legal nullity.

Highly-placed sources yesterday revealed that the embattled Cde Mutasa abandoned his Zanu-PF Headquarters office when he lost his bid to have a Central Committee seat in Makoni District, but looted all essential party documents from the office he was using in the President’s Department where he had been generating, receiving and filing party correspondence over the years.

Lawyers yesterday said Cde Mutasa committed a theft case and would be arrested if Zanu-PF reported the matter to the police.

Said a source close to developments; “He took all the documents from the party. He used the party papers for the frivolous and vexatious litigation.”

Zanu-PF has since advised Cde Mutasa to return the documents, failing which a theft charge will be filed with the police.

“When he was defeated in Makoni for the Central Committee seat, he went to the party headquarters where he was not operating from since he was now using the Government offices at Chaminuka Building. He said he was handing over the office to those to come after him, but he did not hand over the stuff, he took it to the Chaminuka offices.

“Cde Mutasa has been generating, receiving and filing correspondence on party matters from the office he was using at the President’s Department at Chaminuka Building. He had a secretary identified as Mrs Sabina Chiteme, who is also believed to be one of his wives,” said the source.

Zanu-PF director of administration Cde Dickson Dzora, yesterday confirmed the party was handling Cde Mutasa’s theft of documents issue, but declined to disclose more detail.

“I will comment on the matter at the appropriate time. I do not want to geopardise our investigations,” said Cde Dzora.


However, highly placed party sources disclosed to the Herald yesterday that Zanu PF was determined to retrieve the documents stolen by Cde Mutasa amid fears he might be tampering with them to abet his case that legal experts said was thin on the law but thick on political allegations.

“There are documents he has been receiving, we want them. We also want to see the documents that he has been generating after leaving office. He is guilty of theft of party documents and a demand has been made that he return the documents, failure of which a police report will be made,” said the Zanu-PF official.

Prominent city lawyer, Mr Jonathan Samukange, yesterday said the law was clear that taking away some important company documents when leaving the office was a criminal offense.

“The law is very clear. Taking with you company property including documents after your term office is a criminal offence. He stole those documents. He intended to deprive the owner of the documents. Zanu-PF can report him to the police,” said Mr Samukange.

Said another lawyer who declined to be named; “He stole the party’s property; he must return it or risk arrest.”

To prove that Cde Mutasa had been stealing party documents, his lawyers Gula Ndebele and Partners on January 19 this year wrote to him requesting documents to prepare an application (D. Mutasa and others V Zanu-PF).

“I make re reference to the discussion we had this afternoon and wish to state the documentation we need to found our case as below;”-

“1.The facts in sequence and the dates when the events alleged happened. We shall then reduce to supporting or founding affidavits depending on their content.

2.The organs of the party from the lowest level, their hierarchy and functions.

3.The procedure for holding elections at the various levels from the highest to the lowest.

4.A detailed narrative of how these were done this time round at all the relevant levels. This relates with paragraph one above.

5.Events surrounding elections within the party from the low level to the highest level. This ties in with 1 and 4 above.

6.The new constitution, and the old constitution, which we have.

7.Resolutions of the Central committee, the politburo and congress, leading up to the congress of 2014.

8.Resolutions of the congress before last.

9.Any and all supporting documentation to support the factual issues we will raise in court.

10.Any decisions, deliberations and resolutions of an ad hoc committee set up to deal with pre-congress events, and minutes appointing such ad hoc committee.”

Observers say the fact that Cde Mutasa stole these documents last year meant that his court case had been pre-meditated and that he had been criminally-minded all along.

Sources close to developments said the authorities were now treating Cde Mutasa as a suspect in all break-in cases at the Zanu-PF and government offices were various documents were stolen.

In early September last year, thieves broke into the chamber of Chief Justice Godfrey Chidyausiku at the Supreme Court and stole a desk top computer and a television set.

A few days after the break in, four judges reportedly lost keys to their offices.

Vice President and Minister of Justice and Legal Affairs Cde Emmerson Mnangagwa’s offices at the Zanu-PF headquarters were also broken into in September, while there was an attempted break in at Minister of Transport and Infrastructure Development Cde Obert Mpofu at his Kaguvi Building office this year.Herald Reporter

Zanu-PF provincial executives have started restructuring lower tiers of the revolutionary party in line with a directive issued by the party national political commissar Cde Saviour Kasukuwere early this month.

Cde Kasukuwere directed all provinces to hold elections for all lower tiers such as cells, branches and districts as the party embarked on a restructuring exercising aimed at strengthening it.

In an interview yesterday, Zanu-PF provincial executive members said elections for new executives at cells had started while others indicating that they held inter-district meetings directing them to start the process.

They all expressed optimism that they would meet the February deadline set by the party’s national political commissar.

Zanu-PF Mashonaland Central provincial chairperson Cde Dickson Mafios said they held meetings with all district executive members about the modalities to be followed for the exercise.

“We held meetings with all the administrative districts in our province. It is the district executive members that should supervise branches so the meetings were aimed at spelling out the process.

“Preparatory work has since started in earnest now,” said Cde Mafios.

He said no hurdles had been encountered save for the Mount Darwin West by-election, which has shifted their attention.

Mashonaland West Acting provincial chairperson Cde Ziyambi Ziyambi said they would be convening an inter-district meeting this week to get a feedback of the process in various districts.

“We had a meeting of all districts where we told them to hold preparatory work. We will be convening another meeting this weekend to get a feedback but we have not received reports of any challenges to date,” he said.

Zanu-PF Harare provincial political commissar, Cde Shadreck Mashayamombe, said they were working round the clock to meet the deadline.

“We have held preparatory meetings with several districts. Elections should start in earnest at cell level right up to district within the time-frame we have been given by the national political commissariat,” said Cde Mashayamombe.

Matabeleland North provincial chairperson Cde Richard Moyo echoed the same sentiments by his counterparts, saying the preparatory work was at an advanced stage.

He said they would meet the deadline set by the national political commissariat, given a history of hard work in his province.

“We are busy doing cells. Everybody here is busy with the process. We will certainly manage to complete the process within the given time-frame,” said Cde Moyo.

Midlands provincial secretary for information and publicity Cde Cornelius Mpereri said they held a meeting with all districts to explain the objectives of the party regarding the restructuring exercise.

“We met them to explain what we intended to achieve as a party. We are through with these preparatory meetings and what is now left is to start the process,” said Cde Mpereri.

Although no comment could be obtained from provincial chairpersons from Manicaland, Matebeleland South, Bulawayo and Mashonaland East, party officials in those provinces said the process had started.

The restructuring of the lower tiers of the revolutionary party comes after a successful 6th National People’s conference held in December last year in the capital.

The Congress endorsed new party leadership led by President Mugabe and upheld the clean-up exercise embarked upon by the party to get rid of Vice President Joice Mujuru and her cabal who were working round the clock to unseat President Mugabe.

The fearless teen, Trymore Musonza caught the snake on a Wednesday afternoon last week, much to the awe of onlookers. He then bagged the cold-blooded creature and took it to St Mary’s Police Station.
But Parks and Wildlife officials professed ignorance about the development and said they were yet to get in touch with the Police.

The hero, Trymore, claimed that he is no stranger to these daring feats as he has been at it since he was a little boy.

Sandra is now staying with her aunt in Sunningdale while her sister, only identified as Chelsea, is reported to have taken custody of Sandra's four-year-old child until the issue settles down. "I am no longer with my husband Masimba after the photographs were published in H-Metro and I have since decided to use the front page graphic as my WhatsApp profile picture since it affected my marriage," said Sandra. "My husband was not aware that I went to Macheso show only to be called by relatives and friends after the story was published. It hurt me. "One of my sisters called me names and she took the kid away from me saying (the child) would not take good lessons from me but I am not a whore. "On the day in question I was coming from a family party accompanied by my mother and brothers and we decided to pass through our late grandmother's place near Extra Mile Lei-sure Spot. "I was drunk and we agreed as family to attend the Macheso show. It was my first time to take alcohol. "But besides being drunk, I am a good dancer so Macheso spotted me dancing and he called me to the stage and 1 started show-ing my dancing skills. One of the revelers joined me." She revealed that there were issues in her marriage and she had been warned. The pictures in last Friday's H-Metro was thus the final straw. "Since I had had some previous warnings from my husband, he took advantage of the published pictures and he -together with his relatives - forced me to pack my bags. I apologized but no one stood by me.
"I love my husband. I love my child but alcohol led me to this mess and I regret taking it and I do not think I will repeat it," said Sandra. Sandra said her mother warned her after she was called to the stage but she ignored her pleas and went ahead to dance unaware that H-Metro photographer, Takawira "Photo Vet" Dapi was covering the show and the pictures would eventually be published. Norah, who claimed to be Sandra's mother, confirmed the separation. She also confirmed being with Sandra on the day in question. THE 24-YEAR-OLD armed robber, who was gunned down last Friday in Chitungwiza, was yesterday given a big send-off in his neighbourhood of Highfield. Kelvin Chawana, who was on police wanted list, resided at House No. 6235-242 Street Old Canaan where the funeral took place.



The spectacular send off, similar to that of yet another robber Borris from Mbare who died last year, saw a cav-alcade of cars accompanying his body to Highfield Cem-etery. Some motorists were parked outside with some lads smoking mbanje and playing loud music by Soul Jah Love.


Unlike Borris, who was ferried to the cemetery by vehicles of his close associates, Kelvin's body lay in his coffin in a parlour's hearse. Kelvin, who was in the company of Shyleen Nyamweda, 18, was shot dead last Friday in a shootout in St Mary's, Chitungwiza. This happened after police detectives received information that the wanted armed robbers were at a certain house in Zengeza 5. Police then recovered firearm cartridges from the Kelvin's getaway vehicle. The accused persons were on a ZRP wanted list in connection with five robbery cases which occurred in Avondale, Machipisa and Southerton areas in Harare. HMetro

A prosecutor believes flamboyant businessman Energy Mutodi, accused of fleecing desperate home seekers of more than $500 000, has a case to answer.Prosecutor Mr Michael Reza, told the court that Mutodi and his co-accused, Bonface Chikono, should be put to their defence.

This follows an application of discharge at the close of the State’s case by the pair.

In his response, Mr Reza said Mutodi and Chikono had no right or authority to allocate the residential stands as they had not paid for the land earmarked for the housing project.

“The provisions of the contracts that the accused entered into with the different land owners are very simple and straightforward and unambiguous.

“The accused were to pay for the land in instalments, develop the land and allocate the stands to their beneficiaries, but only after they had paid for the land in full,” he said.

Mr Reza added that Mutodi deviated from the agreed deal and continued receiving deductions from the complainants though the project was clearly in disarray.

“As a logical consequence, the owners of the land, unpaid for and undeveloped, cancelled the agreements. The accused were advised of the cancellation but did not bother to advice the complainants, pretending as if everything was in order when clearly it was not.

“There is nothing civil about the matter. The accused had no capacity to honour the fraudulent project. The matter would have qualified to be civil if the accused owned land that they purported to allocate. They did not own it,” said Reza.

Furthermore Mr Reza said Mutodi’s modus operandi was to hoodwink as many people as possible into believing that he was a genuine property developer. Mr Reza insisted that Mutodi, his company NHDT and Chikono, be put to their defence because he had proved a prima facie case against them.

Harare regional magistrate Mr Hoseah Mujaya will make a ruling on Wednesday.

It is alleged that Mutodi and Chikono embezzled funds meant for several housing projects earmarked for development across the country.Herald

THE putschist cabal led by former Vice President Dr Joice Mujuru has developed a four-pronged strategy in a bid to realise its objective of trying to take over leadership of Zanu-PF having failed to do so at the 6th National People’s Congress.Following our lead story yesterday which quoted four members of the cabal distancing themselves from a Press statement issued by former secretary for Administration Cde Didymus Mutasa claiming that the 6th National People’s Congress was convened ultra vires the party constitution, sources close to developments said the four members were in effect employing one of the cabal’s strategies, that of fighting Zanu-PF from within.
“The strategies include litigation, forming a splinter political party, re-engaging His Excellency, the President through emissaries, as well as fighting from within the Party,” said a cabal source.
“The latest development is that the Mujuru loyalists are going ahead with the fighting from within strategy. As part of those efforts, former Politburo members — Tendai Savanhu, Cephas Msipa and Rugare Gumbo and Minister of State for Midlands Provincial Affairs Jason Machaya — have been reported to be holding secret meetings in the Midlands Province.
“The meetings are aimed at strengthening the Mujuru faction ahead of the party’s district elections scheduled for March 2015.”
The source said the strategy was to ensure that the Mujuru faction loyalists win the majority in the party’s district elections with a view to  influencing the provincial structures.
‘’Mujuru realised that while she controlled chairpersons ahead of congress, she did not control the structures which is why the structures booted out her chairpersons. This is what she is trying to rectify through the district elections,’’ the source said.
Cde Machaya and Mr Gumbo denied holding such meetings.
“I am surprised with those lies, they are scary. Members of the President’s Office told me that there was a report that we are meeting but that is not true.
“The only person, I phoned this year is Cde Msipa whom I wanted to say congratulations we have entered the New Year. I have no reason to convene a meeting because I am not disgruntled. I last spoke to Cde Gumbo before congress, so all these reports are just imaginary,” Cde Machaya said.
Expelled, erstwhile party spokesperson Mr Gumbo added: “We have no reason to convene meetings but we insist that the congress was unconstitutional.”
As a mobilisation strategy, the cabal has resorted to the vote-buying that saw them influence the outcome of provincial elections in 2013, with cabal members dishing out cash to party members so that they can lure the electorate.
Some of the Mujuru loyalists pushing this agenda are former minister Nicholas Goche who recently donated fertilisers to his constituency in Shamva North while Minister of State for Masvingo Provincial Affairs, Cde Kudakwashe Bhasikiti last Wednesday handed over seed capital to Ward Development Committees (WADCOs) of eight Wards in Mwenezi East Constituency.
Meanwhile, Cde Mutasa last Saturday convened a meeting at his house in Rusape for loyalists predominantly from his Constituency.
Some of the notable people among the 35 who attended include party councillor for Ward 8, David Muzarabani who chaired the meeting, another Zanu-PF councillor for Ward 38 and Makoni Rural Council District Chairman, David Mutambara Mutasa, as well as Manicaland Provincial Secretary for Education and Headlands Constituency Secretary, Christine Murembwe, and Cde Mutasa’s nephew, Colonel (Rtd) Tichafara Mutasa.
A source who attended the meeting said the objective of the meeting was to welcome Cde Mutasa and hear his side of the story on developments in the party.
Cde Mutasa is said to have dismissed the 6th National People’s Congress, as illegal, unlawful, null and void.
The source said Cde Mutasa also raised concern with amendments to the party Constitution which he said, led to centralisation of power in President Mugabe.
“This, he said, resulted in the unilateral appointments of the two Vice Presidents, Cde Emmerson Mnangagwa and Cde Phelekezela Mphoko.
“He said that the Vice Presidents’ posts should have been filled through elections instead of appointments.  Mutasa said that the appointments were contrary to what the people fought for during the liberation struggle.
“Mutasa expressed his disappointment with the ouster of former Vice President, Joice Mujuru.  He said that during the swearing-in ceremony of the former Vice President in 2004, His Excellency, the President urged her to aim higher.  He added that Mujuru was now aiming higher in line with His Excellency’s encouragement.  Mutasa said that there was nothing wrong in having Mujuru as the country’s President.’’
Cde Mutasa is reported to have said VP Mnangagwa was the main beneficiary of the ‘’illegal’’ Congress, adding that had elections been conducted, VP Mnangagwa would have lost because of what he called his tainted history, though he did not elaborate.
“Mutasa confessed that he did not know much about VP Mphoko.  He indicated that he had brief interactions with Cde Mphoko during the liberation struggle and after Independence.
“He added that on one encounter, Cde Mphoko approached him seeking assistance to acquire a farm and he had assisted him,” said the source.
The source said Cde Mutasa was asked if he was still the MP for Headlands Constituency and whether he plotted to oust President Mugabe.
“Mutasa said that he was still the constituency legislator.  He added that the recommendation for his ouster by the Zanu-PF Manicaland Provincial Coordinating Committee (PCC) led by the young Turks was doomed.
“He vowed that only His Excellency, the President could expel him from Zanu-PF.  Mutasa dismissed a petition calling for his recall which was handed to Cde Oppah Muchinguri on Thursday, 15 January 2015, at a meeting held at Headlands Hall.
“He said that in Parliament there were Zanu-PF legislators who were sympathising with him and would join forces with MDC-T legislators to thwart the move to recall him.
“He added that he would stand as an independent candidate in the event that the move to recall him from Parliament prevails,” said the source.
Another source said Cde Mutasa confirmed that he had written to Sadc and the African Union on the developments in Zanu-PF.
“Muzarabani who chaired the meeting who is Mutasa’s close associate claimed that the people from Headlands Constituency did not move the motion to recall Mutasa from Parliament.
“He dismissed the petition to recall Mutasa, saying the signatures on the petition were from people who were not from Zanu-PF structures.  He claimed that the people who led the signing of the petition were war veterans.
“Muzarabani called upon the attendees to draft a counter petition to indicate that the constituency was rallying behind Mutasa. Mutasa welcomed the move and encouraged the attendees to immediately draft and sign a petition.  A petition was drafted and signed by 27 of the attendees,” said the source.
After the meeting, Cde Mutasa is said to have invited security personnel at the meeting and advised them that while in India, he had contacted former Attorney-General, Sobusa Gula-Ndebele, to legally represent him in his efforts to have the congress declared null and void.
“He said that Ndebele initially refused, but only accepted the request upon his return from India.  “He claimed that there were some members of the judiciary, mainly judges, who sympathised with him.  He added that the said judges had assured him of a positive outcome, especially if the case was presided over by an independent judge,” said the source.
Rtd Col Mutasa confirmed last week’s meeting though he was evasive.
“Why don’t you ask VaMutasa?”
“Did you hear that Colonel Mutasa convened the meeting? Why don’t you ask members of the President’s Office who also attended the meeting? What is your motive? Ndanga ndiri pamba pababa vangu. Why are you asking me ini ndanga ndiri pamba pababa vangu?” he said.
Cde Mutambara-Mutasa distanced himself from the meeting.
“I do not attend meetings in Headlands Constituency because I am in Makoni Central so I deal with Cde (Patrick) Chinamasa not Mutasa,” he said.
Efforts to get comment from Cde Didymus Mutasa were fruitless.
A senior Politburo member, who spoke on condition of anonymity for fear of breaching protocol said, ‘’we are aware of what they (Mujuru cabal) are doing. They have not started now, this double-speak is their trademark, but we are not fooled.’’
Cde Mutasa is leading the litigation strategy and has since drafted an application with the assistance of Mr Gula Ndebele and Mr Addington Chinake of Kantor and Immerman though he has been struggling to find instructing lawyers and an advocate to file the application at the High Court as the two lawyers who helped draft the application were reported to be uncomfortable with associating with a case that has no legal merit.
Embittered, former spokesperson Mr Rugare Gumbo has become the spokesperson of the splinter party strategy, and this week told the Standard newspaper that Dr Mujuru would launch a political party by March, while the other members of the cabal professing allegiance to President Mugabe were said to be pushing the strategy of fighting from within.
It could not be established who was the face of the strategy to engage the President although Cde Mutasa was quoted saying he wanted to engage the President. Herald
