Magistrate says Lumumba ‘confused’ – keeps changing lawyers

August 02, 2016

A Harare magistrate has described former Zanu PF activist Acie Lumumba as “confused” because he is continually changing his lawyers.

Lumumba whose real name is William Mutumanje, is charged with undermining President Robert Mugabe’s authority after telling him f*** you during the launch of a new party.

On Tuesday, the Magistrate, Mr Vakayi Chikwekwe chided Lumumba for “bringing a new lawyer for every court session”. This was after he brought Advocate Zvikomborero Chadambuka to represent him.

In the last court session, Lumumba was represented by Advocate Nelson Chamisa. Earlier on he had been represented by Mr Arshiel Mugiya. Chikwekwe yesterday inquired if the new advocate was instructed.

The defence counsel produced a letter from Lumumba’s first lawyer, Mr Mugiya, which Mr Chikwekwe said was not clear. Prosecutor Mr Oscar Madhume said the matter was being continually postponed at the insistence of the accused.

To this Mr Chikwekwe said: “Accused you are confused, go and put your house on order.

“With so many lawyers in the country, I wonder how many you will bring to this case.”
Former Zanu-PF activist William Mutumanje, also known as Acie Lumumba
The matter was adjourned to August 11.

Lumumba seeks Constitutional Court referral of his matter following the dismissal of his application challenging his placement on remand.

He said his constitutional rights as enshrined in the Constitution were being infringed upon.

Allegations are that on June 30 Lumumba said “Mr President Robert Gabriel Mugabe f*** you. I am drawing the red line, our kids are in trouble so it is a red line I know and my name is Lumumba, Lumumba, Lumumba . . . ”

He was addressing a press conference where he unveiled his political party.

It is further alleged that he went on to say that if anything happened to President Mugabe, his children would be dealt with.

“I am someone’s child, a war veteran’s child, you can touch me, but I hope you live long because God forbid something happens to you and you leave your kids, they will be touched too.”

This week Dr Alex Magaisa, a law lecturer at Kent University in the United Kingdom said that Section 33 of the Criminal Law (Codification and Reform) Act that provides against insulting the president is unconstitutional as it is too vague and violates freedom of expression and citizens’ political rights.

“Section 33 is an outdated and unjust law which is not fit for purpose. It is unconstitutional and should be struck off the statute books because it is a serious hazard to democracy,” said Magaisa in a recent blog. (Read the full article here).

“An executive president is an active politician who routinely trades arguments with and exchanges occasional political jibes against opponents, especially during election time.

“It is inherently unfair for a legal system to give protection to a president who freely criticizes and insults competitors whenever opportunity permits,” said Magaisa.

“Indeed, the reality in Zimbabwe is that President Mugabe has often publicly insulted his political rivals and other critics and yet the legal system has often descended heavily upon those who allegedly insult him,” added the law expert.

He added: “A law that fails to treat all persons equally falls short of the standard of the right to equal protection of the law and against non-discrimination which are protected under Section 56 of the Constitution.” Nehanda Radio

Zimbabwe War Vets Joins Fight Against Police Brutality

July 25, 2016
ZIMBABWEAN War Veterans Minister Tshinga Dube has blasted recent police brutality, a report said today.
According to NewsDay, Dube said that the mauling by dogs and teargasing of demonstrators, some of them children, during the recent widespread demonstrations in the country had been "uncalled for".
Dube further called on the authorities responsible for the police to look into how they treat children during demonstrations.

"It's very, very unfortunate. So what we can only do is to speak to their higher authorities. They [authorities] must look upon these issues very seriously. Kids are kids and you will find that anywhere in the world they are taken by storm, and if that happens, they want to be seen participating," Dube was cited as saying.
A previous report said at least 43 kids had been hospitalised after inhaling teargas let off by riot police inside their block of flats in Bulawayo.
A recent report said that a one-year-old baby died after she allegedly inhaled teargas.
The baby was sleeping when cops arrived and fired teargas canisters.
The father, David Mutasa, said he noticed his daughter had difficulty breathing and tried to get the police to help, but his pleas fell on deaf ears.
This comes just less than a month after the country was brought to a standstill by protesters who have been calling for President Robert Mugabe's head over the country's worsening economy.

Zimbabwe Bond Notes Secrets They don't want you to know

May 30, 2016
Zimbabwe Bond Notes Secrets They don't want you to know
A Bond is a Promise so that capitalists can invest using our real money, a bond is a token, like the one u get if u buy coke without empty bottle deposit, Bond money is like fuel coupons. Bond notes are a diversion so that capitalists borrow your real money while you don't realize it.
Automatically having bond notes, it means the bank has tricked you and borrowed your money without you knowing or realizing ,

Bond is a future liability, someone will have to pay later.
Bond has no insurance, it can be useless at any second

Currency and cash are 2 different things, Currency is a system, and money these days is not backed by physical liabilities. but its value is fiat, meaning its based on faith. A currency is a promise and currency value is the bearers belief in the promise fulfillment. And if people don't believe in Bond notes then their value is depreciating.
It costs money to make bond coins, Why not utilize already existing currencies, like zimswitch, Ecocash, Mobile money, Systems like ecocash need a small upgrade to a peer to peer instant payment system,
Central Bank does not want you to externalize USD, not because it causes money shortages, It does not cause money shortage because its your money not Zimbabwe's money. Central bank just doesn't want you to lend other countries bank money,

They want you to lend it to them so when you want it they will tell you that they don't have cash, that's a lie .
Zimbabwe Bond Notes
Zimbabwe Bond Notes and Coins

Its not that the bank has no cash, Its because the bank has no money they don't want to give you the little that you have so they can invest in on the stock market.
Bond notes will not allow you to import, Central bank will hold  us dollars and release bonds,

Where will they put all the money they will be holding? is it going to disappear or they are doing to put in on the black market so few individuals can benefit.
If i import using my money, i will not go to the bank and claim it because i have already used it. So what causing cash shortages???
Loans are the main tool in cash shortages because banks create money in the form of loans , the money is coming from nowhere , This money was created from nowhere not backed by physical commodities so, Importing doesn't harm the bank unless the bank is in debt and the bank doesn't want to have to send foreign currency to the country of import purchases.
There is cash shortage because our System keeps creating money forgetting they cant create the physical cash. If people work and earn money then there must not be cash shortages because people have worked and got paid. Civil servants salaries coming from tax money, its real money. If a supermarket sells to a person using bank cards money will be debited from the buyers account and credited to the seller, accounts balance and does that cause cash shortages?. Its simple money was created, banks created loans which are not backed by real physical money, The central bank borrowed money from the future and the country goes deeper into national debt and the workers suffer and go poorer , whilst capitalists and bankers get richer. Later in years Recession happens bond notes are created and credits go stale and disappear.
Bond notes are only a gimmick Zim dollar is already working virtually so bond coins have no advantage or disadvantage.
Solutions
Allow international banks to operate in Zim in a free market system, Richest countries in the world are at least 80 percent free market economies.
The government limits export because it would not directly benefit from peoples real cash money. You bank your money and when you want to use it outside Zimbabwe it will be valueless, So solution is to open Foreign Currency bank accounts with international banks.
Barn Bank Loans, Loan is money which is not there and there will be massive cash shortages until all people pay up loans.
Why is cash not Balancing with money in the banks?
If i have 1000usd cash and put it into the bank along with other depositors then after a month I want to withdraw my 1000usd and the bank tell me there is no cash.
-People in control own banks, Capitalists can not be politicians. In Zengeza we have Chidhakwa a member of Parliament, who failed to run a small bakery, how can he help a community and a nation?
-Politicians Experienced in the wrong things not wanting to employ consultants.
-No School Teaches people to think or to be clever, its not about education but track record, People who changed the world the most where school dropouts.
Fritz Harber invented the haber process at age 17
Mark Zuckerberg, i wont say
Pythagoras came with the Pythagoras before he was 40, originally he was a sculpture maker and he was not a schooled man.
John blur theory of investment at age 33
All the economic havoc in Zim is scaring away investors because Zim business climate is unpredictable. Privatization then withing a short period, They are saying companies must be individualized. Claiming shares from a company that someone invested in with cash and handwork.
Speculation is one of the factors affecting the fiat value of our money, thus making our economics unpredictable, Investors will stop, people wont bank their money,
Too many licenses for everything, Zimbabwe is too regulated and we need a free market system to motivate local investors and citizens to empower themselves and create companies. We all know we have politicians who feel citizens trying to set up something new and big as competition and they shut them down. Like in the case or Radio and TV stations a person like me should be running one but opportunities are always in the same circles. But are we the people being given similar opportunities.
All bank charges must be dropped for convenience purposes, Actually banks should pay interest, so people can use ecocash, mobile money, zip-it for peer to peer trading and not need cash. if there r no charges or complicated processes kana madomasi pamusika panenge akutengwa ne ecocash or mobile money.
Anyway banks use this method, most banks here in Zim operate under a foreign intermediary bank, they are more like agents in big offices. They externalize foreign currency benefiting but the nation suffers, by putting ur money in their banks you are also externalize money, in other ways these banks are embassies of foreign banks.
SUBSTITUTE TAX, have people bring in money from outside. free duty, govt will benefit the tax from sales tax, Vat pa internal trading MasterCard and Visa USD international Accounts.
Do you need to make Bond notes for money that does not exist?
Isn't that creating money from thin air?
Please don't limit the people in hard times like these

According to the regulations, this does not apply to motor vehicles bearing foreign registration number plates that are in transit or on a temporary entry permit. “Any person who contravenes some of the sections of the regulations commits an offence and shall be liable, on conviction, to a fine not exceeding level five, or to a period or imprisonment not exceeding six months or both such a fine and imprisonment.”

Football legend Freddy Mkwesha dies

December 08, 2015
HARARE giants Dynamos yesterday said they have lost a fatherly figure who will be difficult to replace following the death of Zimbabwe legend and vice chairman of the DeMbare board of directors, Freddy Mkwesha. Mkwesha, who was arguably one of the finest players to emerge from Zimbabwe, passed away in the morning after a long battle with diabetes.
He was due to celebrate his 74th birthday this Saturday, December 12.
Dynamos board chairman Bernard Marriot yesterday said the Glamour Boys family was devastated by the loss.
Mkwesha was one of the founding members at the Glamour Boys in the early 1960s before he went to play in Europe.
Marriot, who was a teammate during his playing days, said Mkwesha was a role model on the pitch.
At the time of his death, Mkwesha was working as advisor to the Dynamos board.
Marriot said the Glamour Boys are planning to have his body paraded at Rufaro tomorrow.
“We are devastated. This is a great loss to us as Dynamos family. The void will be difficult to fill because he was a man who was always ready to give advice whenever we turned to him for guidance.
“He helped many people build their careers, including myself. We played together in the 60s and as you know I was a very temperamental player and he was one person who would always cool things down.
“Ask anyone, he will tell you that he was a very humble man. He maintained his character up to his old age and I must say we have lost a fatherly figure,” said Marriot.
Mkwesha had not been feeling well for some time after he was diagnosed with diabetes.
His condition deteriorated last Friday when he collapsed and was admitted at Harare Central Hospital where he finally lost the battle.
His nephew, Cosmas Mkwesha, told The Herald that the former Zimbabwe international is expected to be buried tomorrow at his rural home in Goromonzi.
“As a family we are extremely shattered. He was the most senior surviving member of the family and now we are left with a huge void. Mourners are gathered at his home in Glen Norah.
“Consultations are still taking place, but we are hoping to take his body to Chinjika Village, Goromonzi, tomorrow (today) and we expect the burial on Thursday,” he said.
Mkwesha was one of the players in the trailblazing Dynamos of the early 1960s which was formed when black players from Salisbury United and Salisbury City came together to champion black empowerment in football during the oppressive Rhodesian era.
This Dynamos team was so good they won their first championship in the year the club was formed in 1963.
A fearsome striker during his playing days, Mkwesha is celebrated as the first black Zimbabwean to play professional football in Europe.
At the age of 25, he signed for Sporting de Braga in Portugal in 1966 where he played in the same league with World Cup legend Eusebio of Benfica.
He later returned home and coached Harare giants CAPS United.
Marriot, who played alongside Mkwesha during the 1960s, remembers vividly how the former striker used to terrorise opponents.
“We formed a very formidable combination with him on number nine, myself on the right, Nathan Maziti on the left flank while Jairos Banda played number 10 and Allan Hlatshwayo or Richard Chiminya at number eight.
“This team ended the dominance by the white teams who had been discriminatory against the blacks. Most importantly, it removed the general feeling among the black majority that white men are superior and should be feared.
“We also showed to the politicians that Africans are capable enough to run their own affairs if left to do their own thing,” said Marriot.
Sunday Chidzambwa, another of the Dynamos greats who worked with Mkwesha during his coaching stint at CAPS United in the 1980s and again in the national team as assistants to Mick Poole, said Zimbabwe has lost a football icon.
“He was more than a gentleman. He always strived to have good relations with everyone he worked with. I viewed him as a brother, a father and a disciplinarian. I enjoyed working with him.
“I was his assistant at CAPS United and we also worked together at the national team where we were assistants to Mick Poole together with Ashton Nyazika and Peter Nyama.
“We teamed up again in the Dynamos board and I must say I learnt a lot of things from him which helped shape me,” said Chidzambwa.
Dynamos president —Kenny Mubaiwa — said the club was saddened with the death.
“As you know he was one of the founding pillars of this institution called Dynamos. Over the years, he has been working very hard behind the scenes for this club to be where it is today.
“He was full of knowledge, a soft person who usually kept his peace even in those stormy meetings but when he spoke everyone listened. He always gave the best advice when it mattered most,” said Mubaiwa.
One of the players who worked under his wings at the Green Machine, Frank “Dealer” Nyamukuta, said the death of Mkwesha was a blow to the Zimbabwean football fraternity.
Nyamukuta, who is now based in the United Kingdom, posted on his Facebook wall as condolence messages poured in from around the world.
Newly-elected ZIFA president Philip Chiyangwa joined the nation in remembering the life of Mkwesha and his contribution to the domestic game.
Chiyangwa said the association will ensure that Mkwesha is accorded a befitting send-off.
“Mkwesha’s immense contribution to the beautiful game is undisputed and it touched many lives in pre-independent and post-independent Zimbabwe.
“Freddy Mkwesha was an outstanding player, administrator and coach and we will never forget his countless accomplishments and contributions he made to the number one game.
“Freddy Mkwesha served football with distinction and will be remembered for huge successes in the beautiful game.
“The Zimbabwe Football Association is greatly hurt by the death of such a gifted footballer, who moulded the lives and careers of many Zimbabwean footballers.
“Our gallant footballer Freddy Mkwesha served the game with great distinction and was no doubt an inspiration to our country’s current crop of exciting players.
“Allow me on behalf of the Zimbabwean football family, to extend my deepest condolences to the family of Mkwesha and his loved ones.
The Sport and Recreation Commission described Mkwesha as “football elder.” SRC director-general Charles Nhemachena said Mkwesha was one of the greatest players Zimbabwe produced.
“Freddy was Zimbabwe’s first football export to Portugal in 1966 at the age of 25. This was testimony of his great football skills and that is a manifestation that sport transcends all barriers. This is so because Zimbabwe was not yet independent then.
“After his playing days, Freddy became one of the best local coaches and went on to win various trophies and accolades with mainly CAPS United.
“Freddy was one of the ‘Football Elders’ and it will only be befitting for the local football mother body ZIFA, to honour his contribution to football by resolutely addressing the challenges that are currently bedevilling football. For it was through the likes of the late Freddy Mkwesha that our football now commands a huge following.
“On behalf of the SRC Board, management and staff I would like to convey our heartfelt condolences to his family,” said Nhemachena.
Mkwesha is survived by his widow Agnes and eight children from three different marriages. At the time of his death, he was staying with Agnes, who bore him two girls — Nyasha and Cynthia, who is pursuing university studies.
The former Zimbabwe international also had two daughters — Virginia and Charity — with mbira sensation Stella Chiweshe.
Prior to that, he had sired four children — Pulinho, Freddy (jnr), Isabel and Efelia — with his ex-Portuguese wife Emelia Pashoto Lobo. The Herald

Half a million Dollars for NUST University Library repairs

December 03, 2015
The National University of Science and Technology (NUST) has been slapped with a $600 000 lawsuit for failing to pay for the services of an engineering firm that designed the institution’s central library structure. The university hired ARUP Zimbabwe (Pvt) Ltd to carry out some structural, mechanical and electrical engineering work but failed to pay the company for work done.

NUST, through its then vice chancellor the late Professor Lindela Rowland Ndlovu (pictured here), acknowledged the debt in a letter to the Ministry of Higher and Tertiary Education dated October 30, 2013. Prof Ndlovu, on behalf of the institution, undertook to pay the debt of $598 197 in monthly instalments of $7 121 but that did not materialise. That prompted ARUP Zimbabwe to file summons for provisional sentence against the defaulting university. Yesterday the High Court deferred proceedings to next week after the university’s lawyers had filed their opposing papers.Gill Godlonton and Gerrans law firm is acting for ARUP Zimbabwe while Gwaunza and Mapota Legal Practitioners are representing NUST.

NUST registrar Mr Fidelis Mhlanga deposed an opposing affidavit saying the university was a State institution and that it can only make the payment upon release of the funds from Government.“The plaintiff is aware of this position and it entered into an agreement with the defendant with full knowledge that while its claims for payment would be submitted to the defendant, the funds would have to come from Government

“The defendant has not been provided with funds by the funder, who is Government, with which it could meet any such amount that may be shown to be owing to plaintiff. “Where plaintiff knows that its charges can only be paid when Government has provided necessary funding, it is not entitled to sue for payment,” said Mr Mhlanga.Mr Mhlanga said NUST confirms Prof Ndlovu’s letter to be genuine but it was not an acknowledgment of debt. “The document is clearly not an acknowledgment of debt in the ordinary sense that one would understand it, that is, a document by a debtor to a creditor in which the debtor conveys to the creditor the fact that it owes the creditor the specified amount of money,” said Mr Mhlanga. Mr Mhlanga said NUST was actually surprised how the letter from NUST to the Ministry of Higher and Tertiary Education got into ARUP’s hands when it was not intended for the company. It is NUST’s argument that the claim for provisional sentence was not supported by any acknowledgment of debt as contemplated by the rules of the High Court and that it must fail. NUST wants the case to be dismissed with costs.

Foreigner Rights you didnt know for Zimbabweans in South Africa and Abroad

November 17, 2015
Zimbabweans who jumped border into South Africa and other countries are being harassed by the police in respective countries, our brothers and sisters are detained for attempting to exercise their freedom of movement. They detain and depot them based on laws prohibiting border jumping. Of course they may have entered illegally but once in the country they are refugees according to international recognition of refugee status and should be protected not harassed.

Zimbabweans both who entered the country via a border or those who sneaked in are generally discriminated within a country by being denied rights such as access to work and to education and social services and to a stay in the government of the communities which they are a part of.

Below are some of fundamental rights of foreigners all over the world in all countries under the Universal Declaration of Human Rights.

If any of your fundamental rights are infringed you can take legal action and you can also sue.

Universal Declaration of Human Rights. Article 1.
All human beings are born free and equal in dignity and rights.....................

Universal Declaration of Human Rights. Article 2.
Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. ..................

Universal Declaration of Human Rights. Article 7.
All are equal before the law and are entitled without any discrimination to equal protection of the law.......................

Universal Declaration of Human Rights. Article 8.
Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Universal Declaration of Human Rights. Article 9.
No one shall be subjected to arbitrary arrest, detention or exile.
When returning back to Zim our brothers and sisters are asked to pay a fine at the border post Zim side, without the money for fine they are detained, sometimes goods are confiscated by greedy staff who take advantage of people who are not aware of the law and their rights. Those who are not detained or exiled may be allowed to enter but they wont be allowed to bring anything with them home. Everything is taken by the greedy.

Universal Declaration of Human Rights. Article 12.
No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.
There are many cases where the South African Police raid Zimbabweans in South Africa's homes demanding papers. It is a violation of our rights.

Universal Declaration of Human Rights. Article 15.
(1) Everyone has the right to a nationality.
(2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

Universal Declaration of Human Rights. Article 17.
(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.

Universal Declaration of Human Rights. Article 23
(1) Everyone has the right to work, to free choice of employment, to just and favorable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
Your employer:
must pay you for your work
must make sure that your workplace is safe and
cannot take your passport or work permit away from you.

Every province and territory has an office that deals with labour and employment laws. A person at your local employment or labour standards office can talk to you about fair pay, hours of work, rest periods, working conditions and provide other services.

You do not need your employer’s permission to call this office or visit its website. An employer cannot punish you or have you deported for contacting an employment standards office.

If the law and constitutions of any of countries who signed the Universal Declaration of Human Rights contradicts it that is not a bases for your rights to be violated, you may then take the case to the international court. All the other violations that are work related may be dealt with at the labour court or you may just sue directly yourself.

Cholera outbreak in Mudzi

March 04, 2015
Six cases of cholera have been confirmed in Mudzi and Chiredzi, while another case is being suspected in Chirundu.

Of the six cases, five were recorded in Mudzi, a border area near Mozambique, where the disease has killed at least 41 people so far.

The Minister of Health and Child Care, Dr David Parirenyatwa called on the nation to be vigilant to prevent the spread of the disease.

Minister Cde Parirenyatwa said cholera thrives on poor sanitation hence the need for Zimbabweans to improve hygiene in their day to day lives.

“Rain season is with us Zimbabweans have to improve on their sanitation and cholera is also being passed thru boarders. Areas that are affected are Mudzi, Chirundu and Chipinge," said Dr Parirenyatwa.

Cholera cases surface mostly during the rainy season due to poor sanitation and dirty wet conditions.

The worst cholera outbreak in Zimbabwe was recorded in 2008 when an outbreak in Harare’s Budiriro left hundreds of people dead.

Minister Catches Schools caught offside

Most schools in Chitungwiza and Mashonaland East were caught off-guard recently when Primary and Secondary Education Minister Dr Lazarus Dokora unexpectedly visited.

School heads and staff are said to have panicked when the minister and his entourage comprising his deputy Cde Larry Mavhima, provincial education director Mr Christopher Chihota and the district education officer for Seke, Mr Rich Matimbe conducted impromptu inspection of the schools.

Financial management records for some schools were said to be in shambles and Dr Dokora had to interrogate some headmasters over the way they ran school affairs.

Speaking after the inspection of some of the schools, Minister Dokora said he had decided to make the visits to get first-hand information on how schools were run with a view to taking steps to correct irregularities which were compromising the education sector.

Over the years, most Zimbabwean schools have been plagued by examination leakages, financial mismanagement, poor performance and failure by parents to settle fees.

“We expect through these inspections, which are totally unannounced, to see things in good order,” Dr Dokora said.

“Obviously there will be consequences. Our senior managers like district education officers and provincial education officers must keep a close eye on these institutions.

“We have just started and once we have left the province, the provincial education director and his team will take action.”

He said schools should take a cue from schools like Mandedza High School which was properly run by its headmaster Mr Takesure Kanyemba.

“At Mandedza High School there is sound governance and one would hope that if our schools were run like this school, we wouldn’t be moaning,” Minister Dokora said.

Despite the challenges in the education sector, Zimbabwe still maintains its pole position in Africa when it comes to literacy levels in Africa.

At 91 percent, Zimbabwe leads the literacy rate on the continent. Tafadzwa Ndlovu and Nyemudzai Kakore

Zimbabwe maid jailed for murder after stuffing baby in drawer

February 28, 2015
Harare (AFP) - A Zimbabwean nanny was jailed for 22 years for the murder of a 10-month-old baby she stuffed into a drawer "for crying too much" before she settled down to watch TV.
Violet Moyo, 22, was sentenced on Thursday after being found guilty of murder over what the judge said was a "very cruel and brutal" death, the state-run Chronicle newspaper reported.
Moyo, from Zimbabwe's second city of Bulawayo, was left in charge of the baby boy while the parents went to work and had fed him and put him to bed.
But the child woke up after five hours and started crying, the prosecution said.
Moyo tried in vain to calm the boy and in frustration she wrapped him in a blanket, stuffed him in a linen drawer and shut it while she went to watch a film on television.
She went to check on the child after three hours and found he was dead, the newspaper said Friday.
High court judge Lawrence Kamocha described the baby's death as "very cruel and brutal".
"Despite the baby's distressed cry, you chose to ignore him and went to the lounge to watch a television movie which is quite clear you wanted to kill him," Kamocha said.

Bev in another fight DESPERATE PUBLICITY STUNTS BECOMING TOO MUCH

Jean Masters (L) and Beverly 'Bev" Sibanda chat as Revai Tinarwo (in red scarf) approaches

Raunchy dancer Beverly 'Bev' Sibanda's penchant for an expensive lifestyle has proved costly after she reportedly got involved in a physical confrontation with her hairdresser, Revai Tinarwo, with the latter demanding her dues for services rendered about seven months ago.

The 'debt collection' incident degenerated into a near fist fight as her manager, Hapaguti Harpers Mapimhidze, came to the defence of Bev after they worked in cahoots to evade paying.

The melee occurred at Streambank Bar in Mbare on Sunday evening, attracting the attention of the bumper crowd that was watching Sulumani Chimbetu performing.

The hairdresser, Tinarwo, from Red Alert saloon located along Mbuya Nehanda Street in the capital, heard that Bev was performing at the joint and decided to trail her.

She confronted Bev, causing Harpers to intervene, threatening to beat up Revai.

Harpers defended his violent actions, arguing that Revai had approached Bev improperly.

"She came to us shouting, and that was wrong.

"I have a lot of money, but I am not going to give her because she approached me in a wrong way.

"She must apologise to me because I am a popular person who cannot be seen involved in such small clashes in public," fumed Harpers.

The almost violent confrontation died down after popular socialite Monica 'Sele' Chikasha intervened.

The Zimbabwe Mail claims that it has it on good authority that Bev opened an account with Revai, the service provider, and accrued a debt of $120 backdated to August 25 last year.

Since then, she has been evasive and avoiding Revai in a bid to avoid owning up.

Revai said she tried all means to recover her money, and was now contemplating legal action.

"They attacked me for claiming my money.

"What I need is my money only and nothing else (sic)," said Revai.

To date , Bev has only paid $20, and has proposed a payment plan.

Bev has previously made headlines, claiming that she was operating a thriving clothing business where she is generating huge profits.

Contrary to her claims, her manager Harpers conceded that they had opened an account with Revai because their finances were not sound.
"We opened an account with Revai at the time we left Prophet Magaya (Walter)'s church because our finances were low.

"Revai has been a good friend and we are surprised why she made a scene, claiming such a small amount of money," said Harpers.

Zesa price goes Up

February 25, 2015

Zesa Holdings has said it will have to raise electricity tariffs by six percent to cater for salary arrears amounting to $117 million arising from a gazetted 2012 collective bargaining agreement which management ignored.
The power utility conceded bungling by not honouring the collective bargaining, but is arguing that abiding by the award will result in the payroll shooting by $5,6 million per month, a figure that can only be raised through increasing tariffs.
The arbitrary award, which would have a heavy bearing on electricity consumers, was granted by retired Supreme Court judge Justice Ahmed Ebrahim and Professor Emmanuel Magade.
Zesa Holdings is now offering the workers $21 million spread over four months, arguing that their demands were “unrealistic.”
Instead of paying the collective bargaining award when it was still affordable, the Zesa management for the past three years unsuccessfully contested the result which came out as a result of Statutory Instrument 50 of 2012.
Now, the figure has ballooned and has to be backdated.
The dispute is also likely to cost Zesa another $5 million in tax liabilities, according to calculations by the Ministry of Energy and Power Development.
Zesa head of finance Mr Eliab Chikwenhere said the firm was in a “parlous financial situation” and its liabilities exceeded the assets.
He said in any case, Zesa needed to raise tariffs to meet its obligations.
Responding to the ruling yesterday, a Zesa senior executive said any compliance with the award meant an increase in tariffs.
He said the firm was prepared to part with only $21 million to avoid increasing tariffs and burdening consumers.
“The demands by the workers are unrealistic, but we have come up with a concessionary figure which reflects what the business can pay,” said the senior executive.
“We admit we signed an agreement and we have to comply, but as a gesture of goodwill this is what we can afford. First and foremost, before any considerations, Zesa should be able to generate electricity and that is why we have $21 million as our maximum figure.”
Added the senior executive from Zesa: “Implementing the award will require a six percent tariff increase to meet the $5,6 million additional figure per month of the current payroll. This will burden the already overburdened consumer as well as impacting negatively on service delivery.”
The collective bargaining agreement provided for Zesa to effect a minimum increment of $275 and 12 percent grade differentials, 2,5 percent step (notch) differentials, non-pensionable allowance (30 percent of basic salary), $70 transport allowance and $23 canteen allowance (grade 1 to D2) with effect from January 2012.
In their ruling, Justice Ebrahim and Professor Magade said the power utility should honour the collective bargaining agreement and conduct a re-grading exercise.
They said Zesa should start paying employees according to qualification and seniority.
“The claimants should comply with the National Employment Council salary scales arising from the 2102 CBA,” reads the ruling.
“The claimants should, consequently, conduct a re-grading exercise so that all their employees are placed in their correct grades in the NEC salaries scales, according to each employee’s qualifications, date of entry into service and any other relevant factors, irrespective of the grade such employee currently occupies under the Zesa scales.
“This exercise should be back-dated until the date on which SI 50 of 2012 came into effect and any salaries and benefits should be calculated from that date, and should be completed within six months of the date of this award. Any back-payment should be paid within that period.”
No employee, the ruling stated, should, as a result of the re-grading exercise, receive salary or benefits lower than he or she currently received.
The arbitrators, while acknowledging Zesa was “not fully delivering what it ought to”, said it had created legitimate expectations among the workers and should honour that.
Reads the ruling: “Whilst it is true that public policy dictates that an award which has the effect of driving the employer into insolvency should not be made, it is equally true that where an employer has entered into an agreement with his employees he creates legitimate expectations amongst the workers. Public policy becomes something of an unruly horse which gallops in multiple directions.”
According to the Ministry of Energy and Power Development, the least worker is owed $1 628, while the highest paid (skilled) worker should get about $2 418.
But workers, through the Zimbabwe Energy Workers Union, claim the liabilities to be $5 607 and $37 102, respectively.
The power utility has more than 7 000 workers countrywide.

Tsvangirai has a small Pe**s; Wife Speaks

February 22, 2015

MORGAN Tsvangirai’s wife, Elizabeth, has demanded to be “set free” from her marriage to the MDC-T leader after accusing him of cheating on her with two women. In sensational audio tapes obtained by The Herald, Elizabeth, nee Macheka, also accuses the former Prime Minister of suffering from erectile dysfunction which has prevented them from being intimate since their marriage in 2012.
Macheka, close sources say, had accepted the problem quietly but is livid that Tsvangirai is cheating on her with two other women -Leah Mhundwa, and a Bulawayo woman only named as Nobuhle.
Mhundwa is the young sister to Tsvangirai’s late wife, Susan, who died in a car accident in March 2009.
So volatile is the relationship between Tsvangirai and Macheka that at times they exchange blows.
Tsvangirai blames Macheka for the bedroom woes. He has told her that he does not experience the same problem when he sleeps with other women.
The tapes reveal that on one occasion, Tsvangirai told Macheka that he did not experience erectile dysfunction after romping with Nobuhle, sparking a huge row.
Nobuhle is said to have been in Harare recently and spent three days with Tsvangirai. Tsvangirai and Macheka have not been staying together for months.
Tsvangirai briefly stayed with Macheka at their home in Borrowdale but was chucked out after his wife discovered he was cheating on her with Nobuhle and other women. The MDC-T leader is now staying at the Highlands Government house bought and upgraded for him at a cost of $3 million during his stint as Prime Minister, which ended in July 2013.
Macheka rejects Tsvangirai’s claims she is the cause of his sexual failings, and feels betrayed by the MDC-T leader who is “ungrateful” that she has stuck with him even when there is no fire in their bedroom.

Macheka, in meetings with family members, told how Nobuhle and other women call Tsvangirai in the middle of the night while she is sleeping beside him. The rows sparked by the phone calls usually degenerate into fist-fights.
After reports of a split emerged last year, Tsvangirai invited a newspaper to their Highlands home and disputed a report by The Herald that they were on separation.
At one time, Tsvangirai sent Macheka back to her parents as he believed it was her who brought him the misfortune.
He has also gone as far as Nigeria where he sought spiritual healing from Prophet TB Joshua without success.
Close relatives have held marathon meetings to resolve the impasse between Tsvangirai and Macheka.
In one meeting, held in line with Shona culture, Tsvangirai and Macheka met with his nephew during which she poured her heart out about their problems.
“Last week on Thursday the Machekas summoned Tsvangirai and his relatives to a meeting after Elizabeth told her parents that she could not continue living alone. She also highlighted that she has never been intimate with Tsvangirai since their marriage and wants to move on with her life,” a source said.
Macheka wanted Tsvangirai “to set her free”.
“She told relatives that if Tsvangirai believes that she was the source of his bedroom problems, then he must set her free,” the source said.
Yesterday, Tsvangirai and his wife claimed all was well with them.
“We’re staying together. We’re happy. We’ve no problems at all,” claimed Macheka.
Tsvangirai, through his spokesperson, Luke Tamborinyoka, said: “We can understand the fixation that The Herald has with the brand and person of Morgan Tsvangirai. The truth of the matter is that there is bliss in their marriage. Mr and Mrs Tsvangirai are at No. 45 Kew Drive, Highlands.
“We understand the incessant pursuit and concoction of stories around the life and marriage of Morgan Tsvangirai for political reasons.”
Earlier, Tamborinyoka had tried to persuade this reporter to reveal the source of the story and the evidence.
Tsvangirai customarily married Macheka in 2012, but the civil union was stopped after a court challenge from his ex-lover from South Africa, one Nozipho Shilubane.Herald
